THE Second Division of the Commission on Election (Comelec) granted the Motion to Withdraw Petition for Disqualification against Carmen Barangay Captain Rainier Joaquin Uy, effectively barring any case of disqualication against the barangay captain for alleged fraud in the registration of voters.
This order promulgated on Dec. 18, 2024 effectively stops any case that stems from the alleged anomalous and fraudulent registration of voters for the 2025 election in barangay Carmen, Cagayan de Oro City.
While motion to withdraw the case filed by the Comelec Legal Department stated it needs more time to reassess documents and evidence presented, and further investigation the Second Division evaluated the merits of the petition and said in its final Ruling that “there is no longer any basis for the instant Petition.”
In the two-page order the Second Division agreed with the petitioner that “out of prudence and due diligence” they opted to “evaluate the Petition and the case in its entirely to property and faithfully discharge the Commission’s mandate to enforce and administer laws related to the conduct of elections, ensuring free, orderly, and honest elections.”
The Carrasco & Genoso Law Office who provided legal defense to KapKik Uy broke the news late Friday afternoon in its Facebook page.The law firm said in post that the ruling to grant the petition to withdraw the disqualification case of KapKik Uy “reaffirms our trust and confidence in the processes of the Comelec.”
Prior to the petition by the Legal Department to withdraw the case, the law office filed a 41-page Verified Answer with almost 7,000 exhibits to disprove allegation against him.
