THE Local Water Utilities Administration has filed a motion for reconsideration on the order by the Regional Trial Court Branch 41 to cease and desist from implementing its intervention of the Cagayan de Oro City Water District.
In an 18-page document dated April 29, LWUA represented by the Office of the Government Corporate Counsel argued that the decision was erroneous because the court had earlier ruled that the petitioners had no locus standi or legal standing to press this prayer.
The petitioners in this case were then COWD chair Nelia Lee, directors Gerry Cano and Janet Floirendo, and manager Antonio Young.
LWUA further argued in their motion that the court failed to give weight to the financial assistance contract which would have justified their intervention of COWD.
LWUA also prayed that the petitioners be cited for indirect contempt because they immediately took over the operations of COWD on April 16 after the court issued the cease and desist order.
In their view, LWUA stated that the cease and desist order is not yet final and executory.
