THE Commission on Elections (Comelec) has declared as executory its resolution barring shipping magnate Paul Rodriguez from running as congressman in the lone district of Camiguin.
The issuance was contained in a certificate signed by Comelec clerk of the commission Genesis Gatdula dated April 23.
In the two-page document, Comelec stated that its April 11 resolution on the matter is final because the Supreme Court has not issued any restraining order five days after both respondent Rodriguez and petitioner Rep. Jurdin Jesus Romualdo received copies of the said resolution.
The commission based its declaration on its Rules of Procedure and Resolution No. 11046.
With the resolution being rendered as final and executory, it is now being included in the Comelec book of entries of judgement.
